A ship station must allow both the regulations of its licensing country as well as international regulations while in international waters.
In this case, FCC Part 80 governs maritime radio communication. FCC-licensed ships therefore must follow these regulations in addition to international ones.

This one is all about keeping people safe. More than 12 passengers is likely a commercial cruise ship and more than 300tons is going to have big crew aboard. And you can't make everyone required to have on a radio. (Dingy, ocean kayak, etc.)
